PRIVACY POLICY



I. GENERAL INFORMATION.


1. The administrator of the databases of personal data of the Store's Users is the Seller, Ula Kulczyńska doing business under the name: COCOON Urszula Kulczyńska,with registered office at ul. Bohaterów Westerplatte 18A, 21-040 Świdnik, Poland, EU tax number NIP: PL7122869174, Polish Statistical Identification Number REGON: 060632578.
2. The User's personal data are processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC called the General Data Protection Regulation (GDPR).


II. METHOD, PURPOSE AND LEGAL BASIS FOR COLLECTING AND PROCESSING DATA.


1. The Website collects information provided by the User using an appropriate form, and the scope of required data is indicated each time before the provision of a specific Electronic Service or the conclusion of a Product Sales Agreement on the Website.
2. The data provided in the form is processed for the following purposes:

a) In order to perform the contract for the provision of services (including, among others, execution of orders, settlements, communication related to the provision of services, communication via the contact form). The basis for processing is the need to execute the sales contract to which the User is a party (Article 6(1)(b) of the GDPR).
b) To handle returns, complaints and possible other claims. The basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting in securing information about cooperation (including, among others, the history of your orders, communication with us and payments) in order to handle possible claims.
c) For analytical or statistical purposes. The legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting in the use of financial and sales analyzes for the purposes of internal reporting and setting optimal directions for our development.
d) In order for the Administrator to send marketing content to you. The legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting in the delivery of ordered marketing communications, including in the form of newsletters, i.e. e-mails containing information about current offers, promotions or competitions. The processing of your data for this purpose takes place only if you have agreed to receive marketing information (newsletter) electronically.

3. The User's personal data is transferred to entities providing services related to running the Online Store, especially payment and delivery services, as well as other entities with which the Website Administrator cooperates in this respect. However, only to the extent and time necessary to provide a given service. All entities to which the Administrator shares data guarantee the use of appropriate personal data protection and security measures required by law.
4. User data is also processed in the event of contact with the store via e-mail, chat/messenger, telephone or via social media. III. PERIOD OF STORAGE OF PERSONAL DATA.


1.The User's personal data will be stored:

a) For the duration of the order and after-sales service (e.g. to consider complaints).
b) Until the expiry of the limitation period for potential claims related to the purchase of the product.
c) For the period necessary to fulfill the Administrator's legal obligation (e.g. resulting from tax or accounting regulations).
d) Personal data processed for the marketing purposes of our services are processed until the User objects to their processing for this purpose, withdrawing consent to their further processing.



IV. USER PERMISSIONS.


1. The User has the right to: access the content of the data and request its rectification, deletion, restriction of processing, the right to transfer data and the right to object to data processing, as well as the right to lodge a complaint with the supervisory authority responsible for the protection of personal data.
2. The rights indicated above are not absolute and will not be available to the User in relation to all personal data processing activities.

4. Providing personal data by the User is voluntary, although failure to provide the personal data indicated in the form necessary to conclude a sales contract or a contract for the provision of electronic services results in a refusal to conclude this contract.


V. SECURITY.


1. The en.cocoonmoda.pl Online Store takes care of the security of customers' personal data, therefore wherever personal data is required, the connection between the customer and the server is encrypted with an SSL certificate. Thanks to this, customers do not have to worry that data sent from or to the server will be suspected, intercepted and used by someone.
2. The Administrator takes special care to protect the interests of data subjects, and in particular ensures that the data collected by him is processed in accordance with the law; collected for specified, lawful purposes and not subjected to further processing incompatible with these purposes, and stored in a form enabling the identification of data subjects for no longer than is necessary to achieve the purpose of processing.
3. Personal data will not be made available by the Administrator to other entities, except those that have an appropriate legal basis, in particular if the personal data are necessary to perform the contract to which the User is a party.
4. The Administrator applies technical and organizational measures to ensure the protection of processed personal data, and in particular protects the data against disclosure to unauthorized persons, removal by an unauthorized person, processing in violation of applicable regulations, change and loss.


VI. SOCIAL MEDIA


1. The Administrator processes personal data of Users visiting the Administrator's profiles on social media (Facebook, YouTube, Instagram, Pinterest). This data is processed only in connection with maintaining the profile, including to inform Users about the Administrator's activity and promoting various types of events, services and products, as well as to communicate with users via functionalities available on social media. The legal basis for the processing of personal data by the Administrator for this purpose is its legitimate interest (Article 6(1)(f) of the GDPR), consisting in promoting its own brand and building and maintaining a community related to the brand.


VII. COOKIES.


1. The Website obtains information about users and their behavior through cookies saved on end devices.
2. Cookies are IT data, in particular text files, which are stored on the Website User's end device and are intended for using the Website's websites. Cookies usually contain the name of the website they come from, their storage time on the end device and a unique number.
3. The entity that places cookies on the end device of the Online Store User and obtains access to them is the Website Administrator.
4. Cookies are used for the following purposes:

a) Creating statistics that help understand how Users use the Store’s websites, which allows us to improve the Store’s structure and content;
b) Adapting the Store’s content to the User’s preferences and optimizing the use of websites; e.g. cookies allow in particular to recognize the User’s device – its type (e.g. laptop, smartphone, tablet) and properly display a website adapted to the end device;

The Google Analytics statistics system and Meta Piksel implemented in the Cocoon website code are used for analysis. Cookies enable the display of advertisements, offers and promotions based on browsing patterns of the Store's website. Thanks to this, the content of the Store and the advertising message is better suited to the User and consistent with his interests and preferences. Cookies allow you to limit the number of times you see an advertisement. Marketing cookies may also be used to track the effectiveness of advertising campaigns on third-party sites.

5. The Website uses two basic types of cookies: "session cookies" and "permanent cookies". "Session" cookies are temporary files that are stored on the User's end device until logging out, leaving the website or turning off the software (web browser). "Permanent" cookies are stored on the User's end device for the time specified in the cookie parameters or until they are deleted by the User. Due to the purpose they serve, cookies are divided into: Statistical files that are used to collect anonymous statistics regarding the Store. In order to perform marketing services, the Administrator utilizes the service of the following third party entities, that utilize cookies like Google LLC, Google Ireland Limited and Meta Platforms Ireland Ltd. 3. Data enabling the identification of a natural person are made available only with the consent of that person.
